2.1. The purpose of these Terms and Conditions is to establish the terms of use of the Site by the User.

2.3. These Terms and Conditions constitute a contractual agreement between e-moroccanrugs.com and the User.
The User represents and warrants that they have the legal capacity to enter into a contract, and if representing a company or any other legal entity, they are authorized to act on behalf of that entity.
These Terms and Conditions supersede any prior oral or written agreements or arrangements and constitute the entire agreement between the Parties.
These Terms and Conditions take precedence over any other contractual or non-contractual document issued by a Seller and/or Buyer.
2.4. e-moroccanrugs.com reserves the right to modify these Terms and Conditions at any time. Any changes will become effective immediately upon the release of the updated version of the General Conditions on the Site.
The User agrees to regularly review the General Conditions on the Site to stay informed about any modifications.
Upon request, the Customer may be provided with the updated General Conditions. If the User finds the modified General Conditions unsatisfactory, they are free to unsubscribe from the Site following the procedures outlined in article 19 below.
Otherwise, their continued use of the Site will be deemed as an unconditional acceptance of the new version of the General Conditions.
2.5. The applicable General Conditions are those that are in effect at the time the Order is placed.
2.6. The User has the option to consult and save the General Conditions at any time.
Before confirming an Order, the User must accept the General Conditions by clicking on the designated icon.
3 SITE REGISTRATION
3.1. In order to sell or purchase Articles on the Site, the User must register and create an account. Registration on the Site is free and open to individuals who are 18 years of age or older, as well as legal entities.
3.2. The User can register on the Site by manually completing the mandatory fields marked with an asterisk on the registration form, providing accurate and complete information.
3.3. Users who wish to sell products on the Site are required to provide personal information to e-moroccanrugs.com, including valid bank details. e-moroccanrugs.com is also authorized to request documents that verify the identity of the Seller. These documents are collected for the sole purpose of ensuring the security of financial transactions and preventing fraud.
e-moroccanrugs.com reserves the right to cancel a sale if the Seller refuses to provide these documents or if there are doubts about their validity.
Professional Sellers are reminded of their obligation to comply with laws and regulations related to distance selling contracts.
3.4. By providing their postal address, the User agrees to e-moroccanrugs.com processing the data related to their location. This processing enables the User to search for Articles based on their own or other locations, and allows other Users to identify Articles listed for sale in specific locations.
3.5. During the registration process, the User will choose a username and password. The User agrees not to use an identifier that infringes on the rights of a third party (such as trademarks, legal names, trade names, etc.).
The User must also avoid using weak passwords (e.g., 123456) and regularly change their password to maintain a high level of security.
The username and password are strictly personal and confidential, and the User must ensure their strict confidentiality. Only the registered User is authorized to access the Site using their username and password. Any use of the Site with the User’s username and password is considered to be made by the User themselves.
If a third party gains access to the User’s username and password, the User must immediately notify e-moroccanrugs.com by sending an email to e-moroccanrugs@gmail.com mailing a letter to e-moroccanrugs.com SARL, or calling +212 660-902050 between 9:00 and 18:00, Monday to Friday. The User will then receive a new password by email to the address provided during registration. The User is responsible for the use of the Site and all actions taken with their username and password, except in cases where their account was used after unsubscribing or upon notifying e-moroccanrugs.com of unauthorized use.
4 USER PROFILE
4.1. Upon registration, the User is required to provide additional Information on their Profile. Some Information is mandatory, indicated by an asterisk, while others are optional. Sellers must complete their Profile with the mandatory Information and have the choice to fill in optional Information.
Buyers have the option to provide both mandatory and optional Information on their Profile. Users can modify the published Information on their Profile at any time.
4.2. Certain Information entered by the User will be publicly visible to other Users and/or communicated to Sellers in the event of a sale, which the User expressly agrees to.
5 INFORMATION PROVIDED BY THE USER AND POSTED ON THE SITE
5.1. Each User guarantees that the Information they provide on the Site is accurate, truthful, complete, and up-to-date.
Users are responsible for regularly updating the Information to ensure its accuracy. The User is solely responsible for the sincerity and accuracy of the provided Information.
e-moroccanrugs.com is not liable for any errors, omissions, or inaccuracies in the User’s Information, nor for any resulting damages to other Users or third parties.
5.2. By posting Information on the Site, the User grants e-moroccanrugs.com a worldwide, non-exclusive, transferable license, which may include granting sublicenses, to use, copy, modify, distribute, process, store, and disseminate all the Information the User inserts on the Site.
This includes the authorization for e-moroccanrugs.com to distribute Ads on partner sites and promote them through various media.

The User also guarantees that the Information they post does not violate the rights of third parties or applicable laws, including provisions related to defamation, insult, privacy, right to image, moral rights, or counterfeiting.
The User holds e-moroccanrugs.com harmless against any third-party claims related to the publication of the Information on the Site.
5.4. The User agrees not to include their contact details (telephone, postal address, email, etc.) in Ads, Questions and Answers, or their Shop. e-moroccanrugs.com reserves the right to remove such details without prior notice to the User.
5.5. When purchasing an Article on the Site, the Buyer agrees that their first and last name, delivery address, email address, and telephone number will be shared with the Seller.
The Seller undertakes to keep this Information strictly confidential and not disclose it to third parties.
The Seller agrees to use the Buyer’s contact information solely for the purpose of fulfilling the Order. Unless expressly agreed by the Buyer, the Seller agrees not to use this Information to send the Buyer messages, items, documentation, especially of an advertising nature, through any means (including postal, telephone, or electronic means).
6 PROTECTION OF PERSONAL DATA
6.1. e-moroccanrugs.com places utmost importance on ensuring the security and confidentiality of its Users’ personal data, as it strives to build strong and trustworthy relationships with them.

8 ORDER PROCESS
The Site is a platform that allows the Seller to offer products for sale to Users. e-moroccanrugs.com acts as an intermediary in the ordering process; thus, e-moroccanrugs.com is not a party to the sale that takes place between the Seller and the Buyer, both of whom are Users of the Site.
8.1. Pre-contractual information
8.1.1. The Seller undertakes to describe in the Ad: The essential characteristics of the Item being sold (nature and functionalities of the Item, color(s), material(s), era, style, dimensions, etc.); The condition of the Item; The price of the Item. If the Item is inspired by the work of a known designer (without being an original piece), the Seller may only refer to this designer by indicating that the Item is “in the style of …”.
If the Seller is selling a reissued Item, they must specify this in the Ad and are prohibited from presenting the Item as an original piece.
8.1.2. When creating the Ad on the Site, the Seller provides the price of the Item in EUROS.
8.1.3. The Buyer will have the possibility to ask the Seller questions about the Item in the Questions and Answers section reserved for this purpose in the Ad. The Seller undertakes to answer these questions as accurately as possible to avoid any non-compliance of the Item with the description given in the Ad by the Seller.
